2009 Missouri Bar Committee-Drafted Legislative Proposals

Corrects errors in the 2003 exemptions legislation which inadvertently put some mobile homes and automobiles at risk of levy or attachment by creditors, and corrects an interpretation of Missouri exemption law which has exposed personal injury claims to administration in bankruptcy proceedings for the first time in Misouri history.

Family Law Section    
Amends §§ 452.440 through 452.550, RSMo -- Uniform Child Custody Jurisdiction Enforcement Act adds language which helps courts determine which state should assert jurisdiction over a custody proceeding; provides for the communications between the courts to be recorded, which further assists the appellate courts by providing a record as to the basis for the trial court’s decision; and provides for enforcement of custody orders which currently does not exist.

Talking Points for Uniform Child Custody Jurisdiction and Enforcement Act

Amends §§ 454.850 to 454.997 -- Amendments to Uniform Interstate Family Support Act (UIFSA) were first established in 2001. Missouri has enacted UIFSA, but now needs to pass the amendments so that prosecuting attorneys and the Division of Child Support Enforcement can work more easily with other states when attempting to enforce family support orders.

§§ 452.615 to 452.670 -- Uniform Premarital Agreement Act. The proposed legislation addresses a uniform approach to the interpretation and construction of premarital agreements so that the law can be consistent within the state and with neighboring states.
